Employment Authorization Application (Form I-765)

What it is

Employment Authorization Document (EAD), also called Form I-765, is a plastic card issued to you by USCIS. It allows you to work legally in the US during an authorized period.

As of November 21, 2022, you may work for 90 days without an EAD, but you still need to apply for it after three months. Your employer will be required to check that you have it.

How to get it

To apply for an EAD, fill out Form I-765. This form can be filed online from your USCIS account (Go to menu > Account Actions > File a Form Online). If your family members do not have USCIS accounts because they were in your travel group, create a new USCIS account for every person who intends to work and needs to apply for an EAD.

For Ukrainians coming through the U4U (Uniting for Ukraine) program, there is no fee for submitting the initial application form I-765 (you have to pay for a replacement). To submit the form under the U4U status, choose the “(c)(11) - Ukraine Parole” option in the immigration category dropdown list at the beginning of the form. 

Documents to include

You will need a copy of your I-94 (PDF or screenshot), a copy of your passport (a cell phone picture or scan will work), and a square photo. For the photo, you can either go to any place that does passport photos and then scan the result (they will not give you an electronic file), or you can ask someone to take a picture of you against a white background. The online form I-765 has a link that will help you crop your image to the correct size. 

If you haven’t applied for your Social Security Number (SSN) separately, make sure to request it when filling out the form.
